About this translation. This page is an English translation of maru's Japanese Terms of Service, provided for reference. The Japanese Terms of Service is the governing document; in the event of any discrepancy between the two, the Japanese version controls. The Japanese source is also still in draft form pending final legal review, so this translation may change without notice as that review concludes.
maru Terms of Service
Article 1. Scope
- These Terms of Service set out the conditions for using maru (the "Service"), provided by Zanmaido K.K. (株式会社三昧堂; "we," "us," or "the Company").
- Any user who uses the Service is deemed to have agreed to these Terms.
Article 2. Definitions

Article 3. Account Registration
- Users shall register an account by the method we designate.
- Registration requires a valid email address and other necessary information.
- The Service is intended for users 18 years of age or older. Users under 18 may not register.
- In principle, each User may hold only one account; obtaining multiple accounts is prohibited.
- Users are responsible for managing their account information and password.
Article 4. Special Provisions for the Early-Access Period
- The Service is currently offered on a pre-registration basis (this period, the "Early-Access Period"). During the Early-Access Period, functionality, performance, and stability may be limited.
- During the Early-Access Period, we may change, suspend, or discontinue the Service without notice.
- For data loss or service suspension during the Early-Access Period, we bear no liability beyond the scope of §8 (Disclaimers).
- To help us improve the Service, Pre-Registered Users agree to our use of feedback, usage logs, and the content of reports the Service generates for them. We use this information to confirm report quality (pre-delivery review and post-delivery quality improvement). Details of this handling are set out in Privacy Policy §3.
- Being in the Early-Access Period does not exempt Users from paid-plan fees. Paid-plan fees, the free trial, the start of billing, automatic renewal, and cancellation are governed by Article 5.
Article 5. Fees, Free Trial, Automatic Renewal, and Cancellation
5.1 Paid Plans and Fees
- The fees for the Service's paid plans (the "Paid Plans") are as follows (all amounts include consumption tax).

- The fees in this table are not indicative estimates; they are the contractual fees between the User and us. These fees are identical to those shown on our website's pricing page (
https://nagaiki.ai/ja/plans) and in our Specified Commercial Transactions Act disclosure (https://nagaiki.ai/ja/commercial). - Users select one of the plans at the time of application. Fees accrue in units of the selected plan's renewal cycle.
- If we revise our fees, we will announce the change in accordance with §11 (Amendment of Terms). The revised fee applies from the renewal following the announcement.
5.2 Free Trial Period
- Applications for a Paid Plan come with a 5-day free trial period (the "Free Trial Period"). No fee is charged during the Free Trial Period.
- The Free Trial Period is granted only once per account. If a User who has previously received a Free Trial Period applies again, no Free Trial Period is granted, and the first-period fee for the selected plan is charged at the time of application.
- Registration of a payment method (such as a credit card) is required to apply, regardless of whether a Free Trial Period applies.
- If no valid payment method is registered at the end of the Free Trial Period, we treat the application as cancelled and do not begin the Paid Plan.
- No Free Trial Period is granted when applying using a promotional code under §5.5.
5.3 Start of Billing and Automatic Renewal
- At the end of the Free Trial Period, the account automatically transitions to the Paid Plan, and the fee for the selected plan is charged. Where no Free Trial Period is granted (§5.2, paragraphs 2 and 5), the first-period fee is charged at the time of application, or at the end of the free period under §5.5.
- Unless the User cancels in accordance with §5.4, the Paid Plan automatically renews at each renewal cycle of the selected plan, and the fee for the corresponding period is charged at each renewal (Automatic Renewal).
- Billing is processed through our payment processor (Stripe, Inc.; United States) against the payment method the User has registered. We do not retain card information ourselves; only the payment processor retains it.
- We send a notice to the registered email address before the Free Trial Period ends. Non-receipt of that notice does not affect the start of billing or the effect of Automatic Renewal.
5.4 Cancellation (Stopping Automatic Renewal)
- Users may cancel a Paid Plan (stop Automatic Renewal) at any time from "Plan Management" in My Page (a customer portal provided by our payment processor).
- If cancellation is completed by the day before the next renewal date, no further fee will be charged. If cancellation is completed after the next renewal date has passed, the fee for that renewal period has already accrued, and the cancellation takes effect at the end of that period.
- After cancellation, Users may continue to use the Service until the end of the period already paid for.
- If cancelled during the Free Trial Period, no fee is charged at all.
- Refunds arising from cancellation are handled in accordance with our Specified Commercial Transactions Act disclosure and the refund policy posted on the same page (
https://nagaiki.ai/ja/commercial).
5.5 Promotional Codes
- If a User applies using a promotional code we issue, no fee is charged during the free period specified by that code.
- After the free period ends, the fee for the selected plan is automatically charged in accordance with §5.3, and automatically renews thereafter.
- Promotional codes are subject to an expiration date, a limit on the number of uses, eligible plans, and other conditions. The conditions for each code are as we separately specify for that code.
5.6 Late Payment
- If we are unable to collect a fee through the registered payment method, we will retry collection through our payment processor and allow a certain grace period.
- Users may continue to use the Service during the grace period; however, if payment cannot be confirmed after the grace period has passed, we may suspend provision of the Service or terminate the Paid Plan.
Article 6. Prohibited Conduct
In using the Service, Users shall not engage in any of the following:
- Conduct that violates laws or public order and morals
- Conduct related to criminal activity
- Conduct that infringes the intellectual property rights, privacy, honor, or other rights of us, other Users, or third parties
- Conduct that interferes with our servers or networks
- Conduct that obstructs the operation of the Service
- Unauthorized access or the intentional exploitation of vulnerabilities
- Obtaining information by automated means (scraping, bots, etc.)
- Using AI Output as the basis for a medical, diagnostic, or treatment decision
- Disclosing to a third party, without that person's consent, another User's information obtained through the Service (including Slack community content)
- Disclosing, without the explicit consent of the User concerned, health data, chat content, AI Output, or other information that another User shared on the Service, by screenshot, reproduction, reposting, posting to social media, or any other means
- Lending, transferring, or sharing a Service account with another person (if you wish family members, friends, or housemates to use the Service, please have each person create their own individual account)
- Inviting or registering another person to the Service without that person's explicit consent, or creating or operating another person's account without that person's consent
- Impersonating us or another User, or misrepresenting your identity or your relationship with another person on the Service
- Monitoring, collecting, storing, viewing, or analyzing another User's health data, glucose values, CGM data, connected health-app data, AI chat history, or other personal information without that person's prior consent
- Using the Service for commercial purposes without our prior consent
- Conduct related to anti-social forces
- Any other conduct we deem inappropriate
Article 7. Intellectual Property Rights
- All intellectual property rights relating to the Service belong to us or to those who have licensed them to us.
- Copyright in content such as meal photos that a User uploads to the Service belongs to that User. The User grants us a license to use that content, free of charge and without restriction as to region, period, or method of reproduction, to the extent necessary for us to provide, improve, and statistically analyze the Service.
- Feedback, improvement suggestions, and requests (collectively, "Feedback") that a User provides to us within the Service may be used freely by us for the improvement of the Service, and we owe the User no compensation or acknowledgment of rights in connection with that use.
Article 8. Disclaimers
8.1 Not Medical Advice
The Service is not a medical device and does not provide medical advice, diagnosis, or treatment. The information and AI Output the Service provides are intended to supplement general health information and do not substitute for diagnosis or treatment by a physician or other healthcare professional. For details, see the separate "Medical Disclaimer" (medical_disclaimer_v1.md).
8.2 Completeness and Accuracy of the Service
- We do not warrant the accuracy, completeness, reliability, or fitness for any particular purpose of the Service's content, AI Output, or analysis results.
- The CGM data and health data displayed are based on data provided by device manufacturers, and we are not responsible for the accuracy of that data.
8.3 Interruption, Suspension, and Data Loss
- Except where caused by our willful misconduct or gross negligence, we bear no liability for damages suffered by a User or a third party due to interruption, suspension, data loss, or failure of the Service.
- During the Early-Access Period, the special provisions of §4 apply, and data-loss risk is treated as having been understood and accepted by the User.
8.4 Third-Party Services
The Service integrates with third-party services for AI response generation (Anthropic, OpenAI, etc.), backend infrastructure (Supabase), payment processing (Stripe), operational support (behavioral analytics, error monitoring, web hosting), health-data integration, and similar functions. A full list of our subprocessors is disclosed in Privacy Policy §5 and §6 and on the subprocessors page (https://nagaiki.ai/ja/subprocessors). The terms of use and any outages of these third-party services are governed by each provider's own terms, for which we bear no liability.
Article 9. Limitation of Damages
Except where caused by our willful misconduct or gross negligence, our liability for damages to a User is limited to the total amount that User paid to us in the preceding six months.
Article 10. Withdrawal
- Users may withdraw from the Service (delete their account) at any time from the settings screen within the app.
- Upon withdrawal, the personal information we hold about the User is deleted in accordance with Privacy Policy §9.
- Withdrawal does not automatically cancel a Paid Plan. To stop billing, the separate cancellation procedure under §5.4 is required in addition to withdrawal. If you need help stopping billing after withdrawing, please contact support@nagaiki.ai.
- No penalty applies to withdrawal or cancellation. Refunds of fees already paid are handled in accordance with §5.4, paragraph 5.
Article 11. Amendment of Terms
- We may amend these Terms when we determine it necessary.
- For material changes (to fees, the scope of third-party provision, or changes disadvantageous to Users), we will give notice, via an in-app notice and a message to the registered email address, at least 30 days before the change takes effect.
- For minor changes, posting the change on our website constitutes notice.
- If a User continues to use the Service after such notice, the User is deemed to have agreed to the change.
Article 12. Governing Law and Jurisdiction
- These Terms are governed by and construed in accordance with the laws of Japan.
- The Tokyo District Court shall have exclusive jurisdiction as the court of first instance over any dispute relating to the Service.
